Najmuk – Terms and Conditions

Welcome to Najmuk (the "Platform"), a multi-vendor e-commerce marketplace application. This document outlines the legally binding Terms and Conditions governing the use of our Platform by both Buyers (Customers) and Vendors (Sellers).

By downloading, registering, browsing, or transacting on Najmuk, you agree to be fully bound by these Terms and Conditions.

1. General Framework & Legal Structure

1.1 Ownership & Corporate Legacy

Najmuk is proudly owned, operated, and managed as a digital venture of Today Star Trading Company. Today Star Trading Company is a fully registered, legal, and compliant corporate entity operating with high-professional services in the Kingdom of Saudi Arabia (KSA) for over 15 years.

1.2 Nature of the Platform

Najmuk is an intermediate online multi-vendor marketplace platform that connects independent third-party vendors with consumer buyers.

  • Limitation of Liability: Najmuk does not own, manufacture, stock, pack, or ship any products. Therefore, Najmuk is NOT directly responsible or legally liable for product defects, damages, accurate grading, delivery delays, or any misrepresentations made by the vendors. All transactions and fulfillments are strictly bi-lateral agreements between the Buyer and the Vendor.

1.3 The 0% Commission & Price Integrity Model

Najmuk operates on a disruptive 0% commission model for sellers. Vendors are strictly required to list their products on Najmuk at the exact same price as their physical offline shops. Najmuk does not inflate prices or add hidden commissions, ensuring that buyers receive authentic, lower market rates compared to other online platforms.

1.4 Store Transparency & Direct Purchasing

Najmuk displays the direct physical store address and phone number of each vendor on their respective digital storefronts. Buyers are fully permitted and encouraged to use this information to visit the vendor’s brick-and-mortar shop to make direct, offline purchases if they choose to do so.

2. Terms & Conditions for VENDORS (Sellers)

By registering as a Vendor on Najmuk, you agree to the following operational compliance mandates:

2.1 Same-Day Order Processing

Upon receiving an order notification from Najmuk, the Vendor is strictly bound (paband) to process the order on the SAME DAY. Delays in processing will result in negative performance ratings and potential account penalties.

2.2 Accurate 'Ready to Ship' Status

Sellers must ONLY update the order status to "Ready to Ship" once the product has been physically packed, labeled, and is entirely ready to be handed over to the courier/delivery personnel. Marking items as "Ready to Ship" prior to packaging is considered a direct violation.

2.3 Mandatory Packaging Video Proof (7-Day Rule)

To prevent fraudulent claims and resolve disputes, vendors must follow strict evidence protocol:

  • The Process: While packaging any product, the vendor MUST record a continuous, unedited video.

  • Required Elements: The video must clearly show the Customer’s Details (Name, Order ID, Shipping Label) and visually confirm that the item being packed is free of damages and matches the correct size/color ordered.

  • Retention: The video must be securely retained by the vendor for at least 7 days from the delivery date.

  • Failure to Comply: If a customer files a dispute for a damaged or wrong product, and the vendor cannot provide this video proof, Najmuk will resolve the dispute in favor of the customer. The vendor will be held solely liable to provide a free exchange/replacement or bear the full cost of a refund.

3. Terms & Conditions for BUYERS (Customers)

By purchasing goods on Najmuk, you agree to the following transactional boundaries:

3.1 Strict 7-Day Return and Refund Window

  • Time Limit: Buyers can request a return or refund through the app within strictly 7 days from the date of product delivery.

  • Finality: Once the 7-day window has expired, the app will automatically close the return option. No return or refund requests will be accepted under any circumstances after 7 days.

3.2 Mandatory Visual Evidence for Returns

  • To initiate a return for a damaged item, incorrect size, or wrong color, the buyer MUST upload clear, high-quality photographs and/or a short video showing the defect or mismatch.

  • Return requests submitted without valid visual proof will be automatically rejected.

  • Items must be returned unused, unwashed, and in their original packaging with all tags and accessories intact.

3.3 Order Cancellation & Shipping Fee Rules

  • Before Shipping: Buyers can cancel an order for free at any time before the vendor dispatches it. If an advance payment was made, a 100% full refund will be issued.

  • After Shipping: Once an order has been shipped or is in transit, it cannot be cancelled for free.

  • Shipping Fee Deduction: If a buyer cancels or refuses an order after it has been shipped, the buyer is legally liable to pay the shipping fee. For advance payments, the shipping fee will be deducted, and only the remaining balance will be refunded. For Cash on Delivery (COD) orders, refusal to pay shipping fees upon delivery will lead to the suspension of COD privileges on the platform.

4. Dispute Resolution & Governing Law

  • Intervention: In the event of a disagreement between a Buyer and a Vendor regarding a return, cancellation, or product issue, Najmuk management will review the digital footprints, uploaded customer pictures, and vendor packing videos to issue a final binding decision.

  • Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws and e-commerce regulations of the Kingdom of Saudi Arabia.
